1. Definitions

• "Pensara", "we", "us", "our" — Pensara, a service based at 47 Nakhon Sawan Road, Wat Bowon Niwet, Phra Nakhon, Bangkok 10200, Thailand.
• "Service" — the organisational, administrative, and educational offerings provided by Pensara, including the Getting Organised Session, Family Filing Toolkit, and Neighbourhood Information Course.
• "User", "you" — any person who accesses our website or engages with our services.
• "Content" — all text, printed materials, templates, labels, checklists, and educational resources produced or provided by Pensara.
• "Agreement" — these Terms and Conditions as updated from time to time.

2. Acceptance of Terms

By accessing our website or submitting an enquiry or booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you do not agree to these Terms, please do not use our website or services.

3. Service Description

Pensara provides three services in Bangkok, Thailand:

1. Getting Organised Session (฿3,700) — a one-to-one introductory session covering the collection and labelling of personal retirement paperwork into a clear, findable structure. Organisational in nature only.
2. Family Filing Toolkit (฿10,400) — a physical kit of printed templates, label sheets, and plain-language checklists designed for household self-management of retirement records.
3. Neighbourhood Information Course (฿27,600) — a multi-session small-group course providing general information about how retirement documentation processes are typically structured. Educational and informational only.

All Pensara services are administrative or educational in character. Nothing provided constitutes financial, legal, taxation, or other regulated professional advice. Services are available to residents and visitors in Bangkok and surrounding areas.

4. Nature of Services — Important Notice

Pensara's services involve organisational assistance and general educational information only. We do not:

• Provide financial, investment, or retirement income advice
• Provide legal advice of any kind
• Make recommendations about individual retirement circumstances
• Represent clients before any institution or authority
• Interpret the terms or conditions of any retirement plan or scheme

If you require advice on your individual circumstances, you should consult a qualified financial adviser, solicitor, or other relevant licensed professional.

5. User Responsibilities

When using our website or attending our services, you agree to:

• Provide accurate information when making an enquiry or booking
• Use our services for personal, non-commercial purposes only
• Not reproduce, distribute, or resell Pensara's printed materials without written permission
• Treat facilitators and other course participants with courtesy
• Not attempt to disrupt the operation of our website

6. Intellectual Property

All content on this website and in Pensara's printed materials — including templates, checklists, label designs, written text, and visual layouts — is the intellectual property of Pensara and is protected under applicable Thai law.

You are granted a limited, non-exclusive, non-transferable licence to use purchased materials for personal and household purposes only. You may not reproduce or adapt Pensara's Content for commercial use, training, or distribution without prior written consent.

7. Payment Terms

Prices are quoted in Thai Baht (฿) and are inclusive of any applicable taxes unless otherwise stated. Payment details will be confirmed at the time of booking. We accept bank transfer and cash at our Bangkok office.

Cancellation and refunds: If you need to cancel a booked session, please contact us at least 48 hours in advance and we will arrange rescheduling or, at our discretion, a credit toward a future booking. Cancellations made with less than 48 hours' notice may not be eligible for rescheduling. Physical toolkits that have been dispatched or collected are not eligible for return unless faulty.

8. Session and Course Terms

• Sessions take place at 47 Nakhon Sawan Road, Phra Nakhon, Bangkok 10200, or at a location agreed in advance for group courses.
• Arrival more than 20 minutes late may result in a shortened session. Pensara is not obliged to extend the session beyond its scheduled end time.
• Documents brought to sessions remain your property. Pensara does not retain copies or records of personal documents you present during a session.
• Course content is general and informational. Completion of a course does not confer any qualification, accreditation, or entitlement.

9. Disclaimers

Our website and materials are provided "as is". While we take care to keep content accurate and current, Pensara makes no representations that general information about documentation processes is complete, up to date, or applicable to your specific circumstances. We expressly disclaim any warranty of fitness for a particular purpose.

Pensara cannot predict outcomes arising from how you organise, store, or act upon your personal documents. We accept no responsibility for decisions made on the basis of our general educational content.

10. Limitation of Liability

To the fullest extent permitted under Thai law, Pensara's total liability to you for any claim arising from our services or website shall not exceed the amount paid by you for the specific service to which the claim relates.

Pensara shall not be liable for indirect, incidental, or consequential losses. We are not liable for events outside our reasonable control, including natural disaster, civil disturbance, or infrastructure failure.

11. Indemnification

You agree to indemnify Pensara against any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of our services or website, or from your breach of these Terms.

12. Termination

Pensara reserves the right to decline, cancel, or terminate a booking or course place where a participant's conduct is disruptive or where their participation is inconsistent with the educational, non-advisory nature of our services. In such cases, a proportional refund of the booking amount may be issued at our discretion.

13. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage an initial informal discussion by contacting us at [email protected]. If informal resolution is not reached within 30 days, disputes may be referred to mediation or the courts of the Kingdom of Thailand, which shall have exclusive jurisdiction.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Pensara regarding use of our website and services.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure by Pensara to enforce any provision does not constitute a waiver of our right to enforce it in future.
• Assignment: You may not assign your rights under these Terms without our written consent.

15. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
